Expert and NGO letter on saving the NEC Regulations from the REUL Act kill list

The UK Government has included the National Emission Ceilings Regulations in Schedule 1 (aka the “kill list” of EU-derived law to be revoked) of the Retained EU Law Act (the “REUL Act”). These regulations are vital for reducing air pollution in the UK and, despite minister’s assurances, are not duplicated by any domestic law or government plans.

However, the UK Government can choose to remove these regulations from Schedule 1 via a statutory instrument passed before October 31st this year. In the same way that it has recently confirmed it will do for other EU-derived laws, which it now considers are needed, that are currently on the kill list.

Therefore, ClientEarth, along with 47 health and environmental experts, practitioners, and NGOs, are asking the UK Government to also save these regulations, and prevent the regression of environmental protections for the sake of the health of people and nature.
