ClientEarth’s observations to the Commission on the compatibility of Great Britain’s capacity mechanism with State aid rules – 23 April 2019

Pursuant to the annulment by the General Court of the EU of its 2014 decision authorising a market-wide capacity mechanism in Great Britain, the European Commission is deciding whether to (re-)approve Great Britain’s Capacity Market as a State aid. ClientEarth has written to the Commission, arguing that there is no proven need for the Capacity Market – and that as designed, it appears to favour coal and gas power plants over cleaner technologies.
