Act - 1962 - Concessions Act - Act 124

The only important provision from the 1962 Concessions Act that remains applicable is section 16 which provides for the following lands/timber resources to be vested in the President in trust for and on behalf of the stools concerned:

• All lands within forest reserves, except for private lands that were incorporated into a forest reserve at the request of the private owner
• All off reserve stool lands and Kumasi town lands in respect of which timber concessions have been granted before commencement of the 1962 Concessions Act
• All timber on any other land

Any revenue from land or timber rights vested in the president shall be shared according to the 1962 Administration of Lands Act (section 19) and article 267 of the Constitution.
This means a double trusteeship lies on on-reserve stool lands. Firstly the Constitution vests stool lands in the stools concerned on behalf of and in trust for their subjects in accordance with customary law and usage. The Concessions Act then superimposes state trusteeship upon the initial stool trusteeship.

Amendments

Only sections 1 and 16 have not been repealed by the Timber Resources Management Act (1998, Act 547). In addition these remaining sections only apply with the modifications necessary to give effect to that act.
