This body of case law presents the cases issued by the Polish courts in the area of nature protection, in which the collected evidence allowed punishing for environmental crimes and offences.
It is an educational and informational document, created within the implementation of the project LIFE15 GIE/PL/000758 You have right to effective protection of nature lead by the polish General Directorate for Environmental Protection. The main goal of this European project is to raise the level of awareness and knowledge of the judicial and law enforcement authorities of nature protection, to improve cooperation between them as well as to facilitate law enforcement in the field of legal protection of nature.
In Poland, one of the key issue exposing the nature to losses caused by environmental crimes and offences is failure of the law enforcement authorities to refer the judgements to judicial authorities. Therefore, this compilation of ruling aims at overcoming this issue by increasing the level of knowledge in the field of legal protection of nature.
Body of polish case law
Access to Justice is a fundamental means through which citizens and NGOs can support the implementation and enforcement of laws and policies to protect the environment. The goal of this ATOJ-EARL project is to achieve “Access to Justice for a Greener Europe”. It strives to enhance access to justice in environmental matters by providing information, training and support for the judiciary, public authorities and lawyers of eight European member states. ClientEarth and Justice and Environment are implementing this project with the financial support of the European Commission’s LIFE instrument.
