The analysis included in this memorandum lead to the following conclusions: The Lisbon Treaty has amended but not replaced existing Treaties. It is therefore legally correct to continue applying the comitology procedures (‘old’ comitology procedures’) to the Ecodesign Directive to ensure legal continuity. The rules concerning the participation of the civil society in the comitology processes under the Ecodesign Directive remain unchanged for the time being.
