This briefing on the European Union (Withdrawal Agreement) Bill explains why clause 26 of the Bill is problematic. Clause 26 allows Government Ministers to make Regulations that could allow lower courts to depart from retained EU case law. As well as potentially undermining important aspects of environmental law, there are important legal certainty issues raised by this, as explained in the briefing. The briefing was shared with MPs and Lords before the Bill was debated in Parliament.
