Individual right to clean and healthy air in the EU

This note explains that, according to a correct interpretation of the existing legal order, EU citizens enjoy a right to air quality with levels of pollutants not exceeding the limit values set under the Ambient Air Quality Directive 2008/50/EC. We provide an analysis of the existing system of legal protection and recommend possible options to strengthen the legal framework.
