ClientEarth response to UK consultation on the revised draft National Policy Statements for Energy I

In this response to the UK’s consultation on the revised draft of the National Policy Statements (NPSs) for Energy Infrastructure, ClientEarth focuses on the proposed policy as it relates to the use of biomass for the production of heat and power. With regard to biomass, it is apparent that the environmental assessment of the proposed policy is based on a single assumption: that biomass is a carbon-neutral source of energy. If this assumption is not correct, then the Government has failed to carry out an environmental assessment pursuant to the SEA Directive, and the NPS will also be in breach of the Planning Act 2008.
