26 April 2010 | Read the briefing In this briefing, ClientEarth's lawyers examine the voting rights and duties of EU Member States in relation to international agreements. In particular it explores whether there is a legal justification for requiring EU Member States who are signatories to international environmental agreements to abstain from a vote on a decision in a meeting of the parties of the international conventions because of the EU law principle of sincere cooperation. It concludes that a rule requiring EU Member States to abstain from voting on decisions in international agreements where a minority of states does not agree with the majority’s opinion, has no basis in EU law. |
